Polinc provides website features and other products and services to you when you visit at Polinc.com, use Polinc applications for mobile, or use software provided by Polinc in connection with any of the foregoing (collectively, “Polinc Services”). By using the Polinc Services, you agree, on behalf of yourself and all members of your household and others who use any Service under your account, to the following conditions.

By using this website (the “Site”), you signify your acceptance of these terms and conditions of use (“Terms of Use”), and the Privacy Policy. If you do not agree to all of these Terms of Use, and the Privacy Policy, do not use this Site.
Polinc may revise these Terms and Conditions of Use at any time. Your continued usage of this Site will mean you accept those changes, and you will comply with all applicable laws and regulations. The materials provided on this Site are protected by law, including, but not limited to, United States copyright laws and international treaties.
1. THE SERVICES: SCOPE AND FUNCTIONALITY
Polinc provides a secure platform for Digital Asset Management. Depending on your subscription and settings, the Service allows for two distinct methods of information access:
A. Immediate User-Controlled Sharing: Functionality that allows you to voluntarily share specific data with authorized individuals (e.g., spouse, partner) in real-time.
B. Contingent Verification Protocol: Functionality that allows designated Nominees to gain access only after a verified "Life Event" (e.g., death, incapacity) and successful completion of our multi-stage verification protocol.
2. ELECTRONIC NOTIFICATIONS
You consent to receive notifications from us electronically, such as e-mails, texts, WhatsApp messages, mobile push notices, or notices and messages on this site or through the other Polinc Services. You agree that all agreements, notices, disclosures, and other notifications that we provide to you electronically satisfy any legal requirement that such communications be in writing. When you use Polinc services, or send e-mails, text messages, and other notifications from your desktop or mobile device to us, you may be communicating with us electronically.
3. MESSAGE CONTENT
Our service may send various types of messages to keep you informed about your account and transactions. This includes important notifications such as transaction confirmations, balance updates, and account alerts. These messages are designed to help you stay updated on your account activity and to ensure the security of your financial information. You can expect to receive these messages for your convenience and peace of mind.
4. OPT OUT; NOTIFICATION PREFERENCES
Your control over the messages you receive is important to us. You have the option to manage your Notification Preferences and opt out of certain message types. However, please be aware that opting out of certain messages may impact your experience on our website. We understand that not all messages are equally relevant to every user, so we provide you with the flexibility to tailor your notification settings to your preferences. Your convenience and satisfaction are our priorities, and we aim to strike a balance between delivering valuable information and respecting your choices.
5. YOUR ACCOUNT RESPONSIBILITY
If you use this Site, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices. Polinc reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
6. AUTHORIZED SHARING & USER PERMISSIONS
For features that allow sharing with other users (such as household members):
No Automatic Access: Use of our Services does not automatically grant any third party access to your data. You retain full control over what is shared, when it is shared, and with whom it is shared.
User Responsibility: If you choose to use sharing features to grant access to a third party, you acknowledge that they can view or use that specific information immediately. Proof of Life Inc. is not liable for the actions of any individual you have explicitly authorized to access your account or data.
7. EMERGENCY REPORTING & MANUAL TRIGGERS
The Polinc system allows designated contacts to report a "Life Event" (such as death, coma, or missing status) to manually initiate the check-in process.
Verification Still Applies: A report of an emergency does NOT result in immediate data release. It acts as a trigger for our system to attempt to contact the User ("The Verification Protocol").
False Reporting: You agree that Polinc is not liable for distress or inconvenience caused if a designated contact falsely reports an emergency, triggering a verification check. We rely on the good faith of the contacts you designate.
8. THE NOMINEE VERIFICATION PROTOCOL
For assets not actively shared, access is granted to Nominees only after the Verification Protocol concludes. This relies on:
1. User unresponsiveness to pings;
2. Confirmation from Primary, Secondary, and Tertiary nominees (as configured);
3. Review of emergency reports (if applicable).
Reliance on Nominees: By selecting your Nominees, you vouch for their integrity. You agree that Proof of Life Inc. is authorized to rely on their representations regarding your status. We are not liable for releasing information based on Nominee consensus if the User remains unresponsive to our counter-verification attempts.
9. USE OF THIRD PARTY SERVICES
When you use the Polinc apps, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile software provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.
10. NO LEGAL OR FIDUCIARY ADVICE
Polinc is an information management tool, not a law firm or trustee. Sharing information via Polinc does not replace a legal Will or Trust. We do not verify the legal validity of uploaded documents.
11. DISCLAIMER OF WARRANTIES & LIABILITY
THE POLINC SERVICES ARE PROVIDED "AS IS." PROOF OF LIFE INC. SHALL NOT BE LIABLE FOR:
a) Misuse of specific data items you explicitly shared with others;
b) Release of data to Nominees following a completed Verification Protocol;
c) Any technical failure preventing a user from responding to a verification ping due to carrier or device issues.
12. INDEMNIFICATION
You agree to indemnify and hold Proof of Life Inc. harmless from any claims arising from:
a) The actions of any household member or user accessing your account with your permission;
b) The release of data to Nominees in accordance with your settings;
c) Any dispute between your authorized contacts and beneficiaries.
13. DISPUTES & GOVERNING LAW
Any dispute or claim relating in any way to your use of Polinc Services will be resolved by binding arbitration. These terms shall be governed by the laws of the State of Texas.
14. LEGAL & CONTENT DISCLAIMER
The information provided on this platform, including but not limited to security policies, compliance details, financial asset management features, privacy terms, and service descriptions, is for general informational purposes only. Proof of Life Inc. makes no guarantees or representations regarding the accuracy, completeness, or timeliness of the content presented.
While we strive to maintain current and reliable information, laws, regulations, technologies, and business practices may evolve, resulting in potential updates or modifications to our services that may not be immediately reflected in this documentation.
